Section 4.2 of the Original Declaration permitted the developer to amend the Original Declaration at any time prior to the Turnover Date without the joinder or consent of any person or entitiy whatsoever. According to the First Amendment to the Original Declaration, after the Turnover Date, but subject to the general restrictions on amendments set forth my the Original Declaration, the restrictions may be amended with the approval of (i) two-thirds (66 2/3 %) of the Board; and (ii) seventy-five percent (75%) of the votes present (in person or by proxy) at a duly called meeting in which there is a quorum.
